Part I: Terms of Service

1. Beta Access & Trial

Compoxer ("Service") is currently offered as a beta/trial version. Access is provided free of charge for evaluation purposes. We reserve the right to modify, suspend, or terminate access at any time, with or without notice, for any reason including but not limited to: capacity constraints, abuse, or transition to a commercial version. Trial users may join a waitlist to be notified when full access becomes available.

2. Permitted Use

You may use the Service for personal and commercial music composition purposes. You agree not to: (a) reverse engineer, decompile, or attempt to extract source code; (b) use automated systems to access the Service without permission; (c) share account credentials; (d) use the Service for unlawful purposes; (e) attempt to circumvent usage limits or security measures.

3. Account & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access. We may suspend accounts that violate these terms or pose security risks.

4. Intellectual Property

All Service components—including software, algorithms, designs, trademarks, and documentation—are owned by Compoxer or its licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service as intended.

5. Your Content

You retain ownership of original musical content you create using the Service. By using the Service, you grant Compoxer a limited license to process your content solely for providing and improving the Service. We do not claim ownership of your compositions.

6. Beta Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. As a beta product, it may contain bugs, errors, or interruptions. We do not guarantee availability, accuracy, or fitness for any particular purpose. Use at your own risk.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPOXER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR CREATIVE WORK. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU (IF ANY) IN THE TWELVE MONTHS PRECEDING ANY CLAIM.

8. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be submitted to the courts of Barcelona, Spain, without prejudice to any mandatory consumer protection provisions that may apply in your jurisdiction.

Part II: Privacy Policy

1. Data Controller

We are responsible for processing your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Spanish data protection laws.

2. Data We Collect

We collect the following categories of personal data:

  • Account data: Email address, name, profile picture (from Google OAuth)
  • Usage data: Compositions created, feature usage, session duration, interaction logs
  • Technical data: IP address, browser type, device identifiers, operating system
  • Content data: Musical compositions and related metadata you create

3. Purposes & Legal Basis

We process your data for the following purposes:

  • Service provision (Contract): To create your account, authenticate access, and deliver the composition features
  • Service improvement (Legitimate interest): To analyze usage patterns, fix bugs, and develop new features
  • Security (Legitimate interest): To detect fraud, prevent abuse, and protect our systems
  • Communications (Consent): To send you service updates, waitlist notifications, and promotional materials—you may opt out at any time
  • Legal compliance (Legal obligation): To comply with applicable laws and respond to lawful requests

4. Data Retention

We retain your personal data for as long as your account is active or as needed to provide services. Specifically:

  • Account data: Until account deletion + 30 days for backup recovery
  • Usage data: 24 months from collection, then anonymized for analytics
  • Technical logs: 12 months for security purposes
  • Your compositions: Until you delete them or close your account

5. Data Sharing & Processors

We do not sell your personal data. We share data only with:

  • Google LLC (USA): Authentication services via OAuth
  • Cloud infrastructure providers (EU/USA): Hosting and data storage
  • Payment processors (when applicable): For subscription management

All processors are bound by data processing agreements ensuring GDPR-equivalent protections.

6. International Transfers

Some of our service providers are located outside the European Economic Area (EEA), primarily in the United States. For these transfers, we rely on:

  • EU-US Data Privacy Framework certifications
  • Standard Contractual Clauses approved by the European Commission
  • Supplementary technical and organizational measures

7. Your Rights

Under GDPR, you have the following rights:
